Daniel Hayman charged over child sex at Bondi's Jewish Yeshiva centre

EXCLUSIVE

Arrested and charged: Daniel Hayman
Arrested and charged: Daniel Hayman.

Sydney detectives have charged a businessman with child sexual abuse offences at Bondi's Jewish Yeshiva centre during the 1980s.

A 49-year-old man was arrested on Monday afternoon in the suburb of Queens Park in Sydney's east and later charged with two counts of gross indecency against 14 and 16 year old males at the Jewish Centre in 1985 and 1986.

He has been refused bail and detectives want people with further information about the alleged 1980s offences to come forward.

Fairfax Media has confirmed the arrested man is Daniel Hayman, who has been residing in Los Angeles in recent years.

Despite complaints, Hayman was never reported to police and left Australia to live in the Los Angles Jewish community, where leaders again acted to shield him.

Corporate records show Hayman was a director of a major Australian Jewish educational arm for several years after his alleged sexual abuse of boys.

Fairfax Media has previously revealed that Hayman recently told one of his alleged victims that Yeshiva spiritual leader Rabbi Pinchus Feldman had admonished him about 25 years ago over his relationship with a boy.

The leader of the Organisation of Rabbis of Australasia, Moshe Gutnick, in March revealed he failed to alert police to an anonymous complaint about Hayman in the 1980s.

Rabbi Gutnick said in hindsight he was wrong not to alert police. Rabbi Feldman said he had no recollection of any confession of child sex abuse 25 years ago.

Fairfax also revealed this year an audio recording of another senior Australian rabbi discussing Hayman's alleged interaction with boys or adolescents.

In the tape recording, Rabbi Baruch Lesches said some of Hayman's alleged victims may have consented.

Rabbi Lesches, who was at Bondi Yeshiva at the time of the alleged incidents and now is a major New York Jewish leader, also cautioned against reporting Hayman to police.

He later apologised for his private remarks after Fairfax released the audio of his discussion about Hayman.

Two recent convictions of men associated with Melbourne's Yeshiva college in St Kilda for historic child sex offences have put the spotlight on the attitudes Australia's senior orthodox Jewish leaders to handling abuse claims.

Victorian detectives are investigating how senior St Kilda Yeshiva figures handled complaints against David Kramer and David Cyprus, who were both employed by the school.

Strike Force Bungo was formed last year to investigate child sexual abuse in the Jewish community in Sydney's east. Hayman is alleged to have abuse the boys while a volunteer supervisor at a camp run by the Yeshiva centre.

Police have urged anyone with information to call Crime Stoppers on 1800 333 000 or visit their website.

STATEMENT BY SYDNEY YESHIVA CENTRE

Mr Daniel Hayman was arrested yesterday on charges of child sexual abuse allegations from more than 25 years ago.

Mr Hayman attended Yeshiva Synagogue to pray or for classes but was never an employee or teacher at the Yeshiva Centre. Any volunteer work that he offered Yeshiva did not include responsibility for children.

We would like to assure the community that Mr Hayman currently has no association with Yeshiva and has been disassociated  from the Sydney Yeshiva Centre for more than a decade. He was instrumental in establishing the Tzemach Tzedek Synagogue which broke away from Yeshiva over ten years ago.

There have been media reports that Mr Hayman claims to have privately confessed child sex abuse crimes to Rabbi Pinchus Feldman 25 years ago. Rabbi Feldman does not have any recollection of such a confession.

Rabbi Feldman wishes to reiterate the following which he has publicly said on numerous occasions:

"To make my position absolutely clear, I endorse the unequivocal Rabbinical rulings encouraging any victims of abuse to report to the police and I will continue to support the efforts of law enforcement agencies in investigating and taking action to protect our community."

Yeshiva unequivocally condemns any form of abuse, including child sexual abuse.

As part of a commitment to the highest standards of care for our pupils, our school Yeshiva College has comprehensive child protection policies in place. Those policies and procedures are constantly being reviewed and updated to ensure maximum safety and protection for our students.

As has been widely reported, in 2003 a case of child sexual abuse was promptly reported to the authorities by Yeshiva, and that has always been and continues to be the policy at Yeshiva.

We welcome investigations by the Police to uncover and prosecute against such crimes and are confident in the outstanding competence and professionalism of the Australian authorities to ensure the protection and welfare of citizens in our society.

Agudath Israel

The fascination with this group's downfall and the manner in which they hoodwinked shrewd, intelligent people seems bottomless. Why is the public appetite for details about how they defrauded people so insatiable?

The thousands of people who were wiped out spiritually when the web of deceit ripped apart, have yet to be quantified. Is it because they abused the trust of so many? Is it because they took every last dime of emunah? Is it because they took the lies from rabbis/gedolim when they knew that, and passing it off to the next sucker in line? Is it because of the unprecedented number of people whose trust they abused and lost?

Is it the spectacular amounts of cover-ups that they supposedly gobbled up that is driving the public's obsession with this group?

They are not the first group of crooks and sociopathic liars, and they won't be the last. They are not the first persons to look into people's eyes and lie to them. The world is, regrettably, full of fast-talkers who sweet-talk people into a variety of schemes aimed at fleecing them.

Most of us have had the experience of talking to habitual, bold-faced liars - and realizing that we are being lied to. Most people are intelligent enough to at least be on the lookout for charlatans.

It is true that we live in a period when we are more susceptible to those who are blessed with the gift of oratory and the ability to offer glib optimistic promises. It is doubtful if the current president-elect would be in his position if he wouldn't have been blessed with the gift of oratory. There are many other individuals in leadership positions who are looked up to by a variety of people strictly because of the way they communicate and not necessarily because of their superior knowledge or intellect. Can it be that the fascination with Agudah is that people are enamored by their salesmanship abilities?

What is so different about this group of rabbis? Why is everyone so fascinated by their capers?

These fabulously pathetic Jews generally view themselves and their lives as more important than those of the little people who have to sweat over a blatt gemora. The culture of power and privilege that comes with their immense phony emunah makes these Jews feel superior to common folk. With a multitude of subordinates like Zwiebel, Shafran and Weinberger catering to their every need and want, and a way of life that defies description, they seem to inhabit a parallel universe.

But it's more than that. The delusion of superiority enjoyed by the rabbis is reinforced by the masses who pay homage to them. Even rabbis who speak out against the worship of money, defer to the rich and bend over backwards (very far) to please the wealthy in their community.

Why?..... Speak to any Swiss banker!

A rabbi commands respect and attention wherever he goes. People point him out when he walks into a room and seek his counsel on various matters, most of which he often knows nothing about.

Everyone wants to be associated with gedolim and, more often than not, the barometer of tzidkas is the size of the rabbi's beard and hat. Usually it matters not how corrupt the rabbi is.

With very few exceptions, this is the way of the world. Honesty is viewed as naivete. One who declines to participate in an Agudah Convention because of the dubious ethics of that group of child-rape enablers, or refuses government benefits he may not be entitled to, is scorned as a fool.

The hardworking electrician or craftsman who works from early in the morning to late at night, never overcharging and remaining fastidious about paying his taxes, may not earn any one's admiration. It's the one who cuts corners, gives dishonest answers on government forms, overcharges and plays fast and loose with the rules who often seems to be more respected for his accomplishments.

An honest middle class man who pays his tuition and is punctilious in the giving of maaser and charity to the less fortunate isn't respected enough for his integrity and reliability. The same goes for the kindhearted fellow who doesn't push his weight around trying to dictate what others should do and does not let child-rapists run loose in his Borough Park two inches of backyard.

We have in our midst people of sterling character, individuals who are intelligent, capable and resourceful, who can envision solutions and follow through on a project to completion. These people realize that all their talents and possessions are gifts from Hashem. They remain humble and G-d fearing. It is this kind of person whom we need in positions of leadership, not the idiots we have now.

Unfortunately, however, we don't appreciate these people. We look for people with glitz and glamour of shtreimels, spudiks, Borsalinos, and the ganovim surrounding them. Awed by their success in duping people to buy them huge amounts of yeshiva real estate with private toilets and basements for their rebbes, we put our trust in these people, imagining that they possess the brilliance and competence to lead us to success.

Then, suddenly, our eyes are opened when we see the rabbis taken down by the cheapest UOJ tricks in the book. We are astounded. How were successful Jews taken in by these thieves? How did they allow themselves to ignore the most basic laws of trust that relatively unsophisticated people are familiar with?

The very people who inspired so much envy and hero-worship, and who we turned to for advice and guidance, have been exposed as fatally blinded by their hunger for more money and power. It fascinates people to realize that the rabbis are no smarter than they, and may even be less intelligent. Middle class people are amazed to see that the wealth they so covet is fleeting and meaningless, while the money they have given to fraudulent rabbis was used for the thieves own gain at the expense of the community.

The media will get over its obsession with child sexual molestation in the Jewish community; the public will soon lose its fascination with this story. Yet, long after the allure of these criminal incidents fades, we must remember its lessons.

Don't rush to respect these rabbis again. Don't become enamored by people who seem to to tell you the truth no matter what the situation. Don't judge a person by the black clothing he wears. Be a true Jew -- eliminate the middleman - go direct to the manufacturer! What kind of Jew buys retail?

Remember that sechel - common sense is a Divine gift intended for the recipient to better mankind and those around him. He who uses his gifts wisely has fulfilled his obligations and accomplished what is expected of him. The one who disburses his largess to worthwile mosdos of Torah and chesed has earned eternity for himself and his loved ones. He who squanders it in selfish pursuits or phony tzedakas and thieving yeshiva owners, leads an empty and purposeless life. He fritters away the benefits he could have accrued in this life and wastes numerous opportunities for eternity.

People who lead honest lives don't chase after phony promises and empty words of fraudulent rabbis behind the rainbow. They have their emunah the old-fashioned way - the Torah hakedosha. They avoid subterfuge and dishonesty. When asking sheilos, they take great care to diversify, never putting all their eggs in one rabbinic basket.

They know that nothing works in a straight upward curve; life has its ups and downs that affect every sphere of faith. Now its the down --- kick your kids out of kollel and force them to go to work.

Enough with these bums hamming it up in the Lakewood coffee room. Stop the checks to them and to the Kotlers --- tell Malkiel and Aron to get real jobs. Shenky can get them traffic cop jobs in a jif! You - parents - are expected to work yourselves dead so your kids can putz around in Atlantic City?

Even though your kids are devious, lazy bandits, don't become broken and give up hope when things are pointing down. Maintain your emunah and bitachon. In the good times, don't flaunt your success and don't force others to conform to your meshugasin of attending lavish yeshivah dinners and conventions. Remain committed to the greater good at all times. Tell the rabbis who knock on your door with their hands out, to kiss off!

We are currently experiencing a spiritual depression as well. Many good people are losing not only their emunah but their savings and the possessions they worked so hard to earn. Everyone we know seems to have been forced, at least somewhat, to lower their standard of living. In the dark as to what tomorrow will bring, many are now cutting back on all forms of spending and holding on to what they have.

People upon whom charitable organizations depended to continue their work are no longer in a position to be of much financial assistance. People with hearts overflowing with the desire to help, and who formerly supported yeshivos and enabled them to maintain genaiveshe real estate holdings, the golden chain stretching back as far as the thief was able to deceive you, are themselves broken-hearted and in need of support and mercy. Nothing like a good molesting by a rabbi to get them to appreciate how lucky they really are.

In difficult straits, rabbis, yeshivas and Jewish organizations will find themselves various unethical schemes to attain wealth and success by taking moral shortcuts. When tempted by dishonesty and duplicity, one has but to remember Margo's downfall. In the end, the truth always emerges, but the rabbis' have short memories, are short on brains, and have been shortened by untrained mohelim.

Frauds and lies will only get you so far. Eventually, the treachery will catch up with you. Together with your wealth, all those adoring friends who couldn't do enough for you will disappear.

Everything temporary comes to a crashing end. Only truth is enduring. Shidduchim for your kids will disappear unless you create some new fraudulent Ponzi scheme -- and Agudath Israel will get the government's money to teach you exactly how to pull it off! Project Dope!

At times like these, we search for things that will uplift and inspire us positively. Neginah, song, has the power to do that in unparalleled ways. Good Jewish music is intended to reach the recesses of our neshamos and make us into better people. Simple poetic words of timeless truth when combined with proper music have a way of doing just that.

Sing and declare "Toras Hashem Temimah" loud and often! Beseech God with "Achas Shoalti", and remember our only source of sustenance when singing "V'yiten L'cho Elokim M'tal Hashomayim...."

[The Lord's Torah is perfect, it restores the soul. The Lord's testimony is reliable, it makes the simple person wise.

A Time to Cry - A Time to Learn What is Genuine and What Are Lies!

The # 1 Most Widely Read Post of all 2011

The events of the past several years, very obviously demonstrate the way you and your leaders understand our cultural history. But for the few of us that truly understand our history, as I do, untangling some of its complex strands has practical and intellectual consequences.

In my own case, the hardest - and the most challenging - is my never-ending research of Judaism's core values. I had to unlearn what I thought I knew, and was forced to shed presuppositions I had grown up with and taken for granted internally and intellectually.

This type of introspection, difficult to the extreme, has given me the depth of understanding of the Jewish doctrines to which is part of my very being, embedded in my DNA, and has assisted me in determining, at least for myself, what is divine and what is human.

For those who will never experience my struggle, there is no contradiction at all to the divine and human perception, the challenge is integrating the two. They are not diametrically opposed to one another as your ignorant rabbis would have you believe. They rule out that learned and spiritually inclined Jews, have always sought to discern spiritual truth via their intuition, reflection, senses, and creative imagination.

The rabbis that will deny you your God-given intellect, to experience on your own what humankind was destined to evolve into, a mirror-image of the beauty of what could and should be the Divine will of chochmat ha'briah; the understanding of the evolution of the intellect to adapt to today's realities of truth and practicality. What they would want you to forget, that only with the shedding of the "Church" as the arbiter of truth and morality in the U.S. Constitution, a mere couple of hundred of years ago, was then civilization, at least the United States, able to remove its intellectual shackles burdened and encumbered by nonsense, cruelty, ignorance and hell.

We've developed more in the last few hundred years, than we have in the last untold thousands. That does not come without a price, however. But that is not the thrust of this post.

Rabbis who will deny such experiences, can teach us anything they choose to about God,and have always identified themselves as our "guardians" of the ancient traditions, or Mesorah. They will preach with fire in their eyes and bimah-banging that it is only they that can determine your faithfulness - by your ability to abide by their interpretation of what was handed down from ancient witnesses -- never adding or subtracting anything unless you consult with them first. And these "guardians", who refer to themselves as the "eini ha'edah" or the eyes of the community, that this view of their role expresses appropriate humility; and it vests them and them alone of the Divine Truth, with God's own authority.

These so-called leaders, of course could not ban the imagination entirely, but they effectively channeled your religious imagination to support their opinions, no matter how cruel and ignorant they may be. Everything you are, they teach, is because you are merely an extension of them, not individuals who have the ability to know right from wrong. And if you stray; like Heaven forbid, do not consult with them if an ongoing series of heinous crimes and cover ups are transpiring under your noses, by the very rabbis that will have you consult with them only, than it is you that is the heretic, the maskil, the sheigetz, the oisvorf and the menuvel.

But in fact, these "heretics" having left the intellectual Jewish ghettos of New York, have impoverished the very system that they outgrew. These "heretics" often walk alone - despite the fact that the spiritual inquiry that they undertook, forcing them to leave their ghettos of origin behind, have become primary sources of inspiration to tens of thousands, and eventually their ideas to the vast majority of Jews, because ultimately I pray "right makes might"!

What such people seek, however, is NOT a different set of rules and obligations to their faith, but rather insights or intimations of the Divine, that would validate themselves in experience. Some who have engaged on this path pursue it in voluntary solitude; others participate in various forms of worship, prayer and action, or a combination of the above.

Engaging in such a practice requires the highest form of faith, or belief, but it also involves so much more; the trust that enables us to commit ourselves to what we hope and love. We have the knowledge and experience to declare boldly; "THIS IS NOT SO, I DO NOT ACCEPT THAT!"

The sociologist Peter Berger points out that everyone who participates in tradition today chooses among elements of that tradition. We survived thousands of years BECAUSE we were able to relive, reinvent, and transform what we received.

This act of choice - which the term heresy originally meant - leads us back to the problem that Orthodoxy meant to resolve; how can we tell truth from lies? What is genuine and thus connects us with one another and with reality, and what is shallow, self-serving, or evil? Anyone who has seen foolishness, sentimentality, delusion, and murderous rage disguised as God's truth, knows that there is no easy answer to this dichotomy. Orthodox Judaism distrusts your capacity to make such discrimination and insists on making them for us. Given the often notorious human capacity for self-deception, we can thank your so-called rabbis for this. And the many of you that wish to be spared hard work, gladly accept what these rabbis tell you.

But the fact that we do not have a simple answer, does not mean we should evade the question. We have also seen the hazards - even terrible harm - that sometimes result from unquestioning of religious authority. Rabbi Elchonon Wasserman's tyrannical, unforgivable conduct during the Holocaust comes immediately to mind. Thousands went to their death upon instruction from him. How many hundreds of thousands of "modeh ani l'fanechahs" will forever remain unsaid every morning from the mouths of children?, perhaps only God knows, but I suspect that He does not know either.

Many of us, however, sooner or later, at critical points in our lives, will have to make our own path where none exists. And that, done correctly, is a good thing. As for me, I am resolute, passionate in my beliefs, non-yielding to any ideological foe that crosses my path. I live in my head and in my contemplative soul. Any setback I view as temporary and a challenge to outhink my opponent. I never concede to evil, never...and I never will. My children and your children are counting on me, whether they know it or not.

And so are you....

As the posuk in יְשַׁעְיָהוּ Isaiah - 10:13 says, "The light of Israel will be fire and its Holy One - flame, it will burn and consume its thorns..."

The Tendler Phenomena!

UOJ ARCHIVES DECEMBER 2009

My information differs from the "Chicago" study. Rabbis raping female teens under their care, is much more prevalent than we dare speak aloud - until now. I am not aware if the Chicago study factored in the male teachers of females - or they solely questioned them about females molesting females; and therefore found no incidences of sexual abuse in Chicago by teachers. I can confirm, that although among female teachers and counselors there exists incidences of child molestation, it is much rarer than male teachers raping male students, much less. The summer camping season is upon us - talk to your girls (and boys)!

The Tendler phenomena can be divided into categories:

1- A rabbi places himself in a female school environment - in a position of power and control - where teenage girls are just coming into their raging hormonal sexual desires. A charismatic rabbi able to seduce a weak or naive female student is too easy. If the rabbi lacks extreme yirat Shomayim and yirat chet, a rather too common incidence in girls schools, the children are prey to these evil and seriously deranged - degenerate - sub-humans.

2- Generally speaking, rabbis that teach in girls schools are inferior in Torah knowledge than their counterparts in boys schools, and most, if not all - would not be considered a noted talmud chochom - or a serious Torah scholar. Although there are exceptions, the same findings would apply to rabbis that are principals in girls schools.

3- These rabbis, that are around teenage girls in particular, must be screened to the maximum, and under constant monitoring. The ideal would be - in a perfect world, that no rabbi under the age of 60 years, should be a teacher or a principal of a girls high school. There are exceptions that could be made as far as the age bracket - but far and few. Girls should never seclude themselves with male teachers, and never take a ride home with them by themselves. Parents must make their teenage girls aware of the potential dangers of taking rides with any male, teacher or otherwise. Male relatives that act inappropriately towards teenage children, should be kept away from them. Child rape happens too often in the Orthodox Jewish community, more than anyone will ever acknowledge, as well as in all other communities. Protect your child with knowledge and awareness.

4- The shalom bayit rabbis are for the most part ignoramuses in their ability to counsel couples with marital difficulties. Most of these rabbis that specialize in couples counseling, should never be alone with the woman. They use it as an excuse to get close to them, even if no physical sex takes place - at first. A rabbi that has counseled hundreds, if not thousands of troubled couples over 35 years, stands accused of being intimate with many women.

5- Women should NEVER drop off their underwear for shailos in person, and NEVER pick it up in person. Use the mailbox or leave it at the door with a symbol or a number. Rabbis have used the good ol'underwear trick to lure unsuspecting women into their office, to discuss the circumstances surrounding the spotting or staining.

6- A "known" posek - who is still a practicing hilchos nidah posek, stands accused of forcing his wife to wear the panties of other women left overnight, while he donned others himself. He still uses the "difficult shailos" as an excuse to probe the sex lives of women.

7- Women should never go to a rabbi's study alone at night - unless you are absolutely certain that the wife and older children are at home, and the office door is completely open. There is NOTHING a rabbi has to discuss with you behind a locked door, that he can not say quietly and respectfully with an open door. When you get there - if the wife suddenly went grocery shopping - GET OUT OF THERE! NEVER go to the shul office EVER, by day or night - unless you are with your husband, or if you are single, accompanied by a friend.

8- Any shaila that needs clarification - should be limited to the telephone - and NEVER let the rabbi ask any questions that pertain to your sex life. NEVER!

There are competent and ehrliche rabbonim - but there are many that are not - and will use an opportunity to molest, talk sex, have sex with trusting and naive women. A former "chief rabbi" of a major American city, was able to convince scores of baalat teshuvas that he must accompany them to the interior of the mikve and witness the tevila - as part of their welcome to the Orthodox Jewish community! What followed - you don't need much of an imagination. He used everyone as a door mat for his personal gain, including issuing bogus hashgochos on food items that needed serious supervision; only for the community to find out that he NEVER showed up at the facilities, and had no employees.

Rabbi sexual abuse is real and out there - and comes in many different shapes, forms and guises. If anyone knows of any of these incidents similar in nature to the above - let me know - once verified - I'll hunt them down with all the means available to me - for the filthy pigs that they are, and the damage they do to innocents!

Chabdehu - V'CHASHDEHU - respect - but - SUSPECT!

Ask Torah Umesorah - Can you screen sex abusers in schools?

The Vulnerable Children Bill, now before a select committee, could significantly tighten up on how people work with and for children.

The controversial piece of legislation states that within six months, a new, complex vetting and screening process for teachers will be developed.

The bill stems from the White Paper for Vulnerable Children and the Children's Action plan spearheaded by the Minister of Social Development Paula Bennett.

The minister said training would be made available to all school staff to enable them to detect signs of child abuse.

"It would be both a surprise and a concern if teachers didn't want to do it."

By 2015 standard child protection policies for organisations including schools will be legislated.

These will incorporate reporting systems to recognise and report child abuse.

School's will risk hefty fines if they are found ignoring them.

Amanda Meynell, Child Matters national manager of child protection, said this was a huge breakthrough.

"This is the first time we have had a whole government approach looking out for our vulnerable children.

"Every day there are children who live in fear of abuse and neglect and we don't know about all of them. It's really important that people know what signs to look out for."

She said a lot of Child Matters training was about being safe, not sorry. "Often people don't raise concerns out of fear they are wrong. But we always say ‘what if you're right?'"

The vetting process will ensure that if known child abusers attempt to work with children, they will be identified and the children protected.

Ms Meynell said the vetting system would be more robust than a police and background check. Among other things it would involve having people who knew about child protection on the interview panel, she said.

New Zealand Principals' Federation president Philip Harding said the idea of compulsory child sex training was promising.

"We need to strengthen school staff's ability to recognise and identify the symptoms of abuse in children and then to act wisely swiftly and safely," he said.

"But there are risks around that process as well, like casting questions of doubt on someone who is innocent."

New Zealand Teachers Council director Peter Lind doubted that there could be an easily applied test for child abusers within a school's budget constraints.

"In reality if you wanted a test that would give you very good predictability and be highly reliable and valid, you are asking for a significant psychological screening."

He said teaching staff were required to have yearly appraisals ensuring they were not put in "vulnerable positions" such as finding themselves alone with children.

These appraisals are centred around an annual plan and should consist of conversations with both the teacher and the students, Mr Lind said.

Proof the system works was in the statistics, he said.

"We have over 100,000 registered teachers. We've had shocking cases of paedophilia but in terms of the total number working in the field it's a terribly small proportion that these incidents have happened."

Preventing or exposing that relied on strong policies, open communication and competent leadership, he said.

But the appraisals were not flawless.

"In our experience usually you see indicators that people have acted outside the policies of the school and no one has told them not to."

He said if there were any concerns, it was the principal's job to have the "hard conversation".

"Sometimes we don't broach those subjects hoping they will go away."

But the biggest difficulty arose when no one spoke up, he said.

"There can be lots of checks and balances in place but occasionally someone abuses not only children but the profession itself.

"We need to make examples of those individuals and say this is totally unacceptable behaviour. I can't give you a sure-fire way of avoiding these [incidences] every single time."

Sexually abusing minors is not only a severe crime on every level, but it is a crime against humanity...

In response to your posts about Heshy Nussbaum & Harvey Ehrlich; THANK YOU so much for your work and efforts! (Via e-mail with permission to post.)

Dear Paul,

I was raised in Toronto, and went to Bais Yaakov, followed by seminary. I just found out about this recently, and I am still processing my shock and pain for the known and untold number of his victims. I have a lot to say about this subject, about the way that Toronto dealt/is dealing with it, and the fact that he apparently is welcomed at the Agudah Shul with little consequence.

A shul which is very popular, and has a lot of children who regularly attend and partake in its activities. I want to say to the victims of both Heshy Nussbaum and Harvey Ehrlich, that no matter how alone you feel, or how convinced you are that you are alone, you are not. There are those that do love and care for you, and may not be aware of what happened to you, let alone of your chronic, extreme, persistent suffering. Sexually abusing minors is not only a severe crime on every level, but it is a crime against humanity.

Those co-conspirators are those who knew/know, and who fail to take the appropriate action for the survivors. Such people, NO MATTER their title, position, reputation in the community, etc, are not only responsible, but ENABLE the behavior. Pedophiles are extremely sick and dark people, and modern science has yet to find a cure or explanation.

They can only be supervised, and preventative methods put in place so there will be no more future victims. Jail is the best known intervention at this point. There is no rehabilitating them, and certainly enabling them in any way, is throwing gasoline into an existing inferno.

I know some of his victims, and I say that with a very heavy heart. Victims go through life with a "silent wound", and it doesn't matter how long ago it happened, just that it DID happen to YOU, that your suffering is real, and that you go to the Toronto police, as they instructed. I believe in the end, justice will prevail, and the cries of the victims will be honored.

Like I said, there is so much more I can say about this matter, especially since this subject, and city, is very close to my heart. Toronto leaders is /was lacking grossly in protecting, defending and aiding the victims, and seem to be doing so for the monster, since his father founded Agudah. For the victims: there is plenty of real, genuine love and support for you. I urge you to reach out and embrace it, wherever you are, and who ever you are. Your days of silence and shame can come to an end.

YOU have nothing to be ashamed of. Pedophiles are Masters of Disguise and Deceit, and are in the business of making sure that THEIR toxic poison is transferred and implanted on to their victims. Like this they don't have to believe they are the bearers of such shame and sickness, since their victim now does the job instead of them. But until the victim becomes aware of this very truth, and stands tall enough to return it back to his tormentor. He / she does it by speaking their truth, and resolving not to live in silence and pain any longer.

What follows from that decision is each individual survivor's journey. You are not alone. I was going to post anonymously, but then I realized that I too, am so tired of the hiding.

“This isn’t a problem about a few aberrant cases or an old-fashioned community reluctant to talk to police about sexual matters,” said Michael Lesher, a practicing Jew who has investigated Orthodox sex abuse and represented abuse victims. “This is about a political economy that links Orthodox Judaism with other fundamentalist creeds and with aspects of right-wing ideologies generally. It’s an economy in which genuine religious values will never really rise to the top, so long as they’re tied to the poisonous priorities that elevate status and power over the basic human needs of the most vulnerable among us."

Is Alleged Shakedown Artist a Hero or Crook?

By Paul Berger

Published November 14, 2013, issue of November 22, 2013.
This is a story about religion, sex abuse, power, extortion, bungled prosecutions and the pitfalls of pursuing justice in an insular Orthodox community where disputes are solved internally and mistrust of outsiders reigns.

It involves a convicted sex offender; a Hasidic multimillionaire oil and diamond dealer; a drug addict; a New York assemblyman; a supporting cast of ultra-Orthodox rabbis, private investigators, victims’ advocates, bloggers and lawyers — including Alan Dershowitz — and a cache of secretly taped conversations.

The story plays out against the backdrop of a bitter 2013 election battle for the post of Brooklyn district attorney in which claims of corruption, connivance and race-baiting abounded.

But it began for me in 2010, in a courtroom in Brooklyn, where Baruch Lebovits, a Boro Park cantor recently convicted on eight counts of child sexual abuse, appeared for sentencing.

On one side of the courtroom sat a phalanx of Lebovits’s black-clad supporters in neat rows. As one of Lebovits’s daughters entered the courtroom, she turned to the mass of advocates occupying the benches opposite and, fixing her red, raw eyes on them, insisted, “My father is innocent.”

The advocates, many themselves victims of other ultra-Orthodox child molesters, were in court that day to show support for the victim and to see if justice would finally be served.

Prosecuting child sex crimes is hard enough in a secular society, but in the ultra-Orthodox world, with its prohibitions against gossip, lashon hara, and ratting out a Jew to the secular authorities, mesirah, it is tortuously difficult.

Parents of ultra-Orthodox victims must get permission from a rabbi before they can report their child’s abuse to the police. Even with permission, they. and their families are often barred from synagogues and schools. They are publicly shamed and denounced, their businesses destroyed, their marriage prospects shattered.....

THE UOJ CLASSICS - REPOSTED FROM LAST YEAR:

I need no introduction Chaim Dovid, but thank you anyway.

I believe in Jewish Exceptionalism, not necessarily in the orthodox sense of the term (of course!). We were destined to be a great people only if we act as a great people. The same applies to us as Americans. We are a great nation because of the vision of the Founding Fathers' wisdom in setting up the rules and regulations called the Constitution, with the ability to add Amendments if deemed necessary, only after great scrutiny and consideration....And act with dignity in implementing the very basics of human needs with the understanding that societies can only exist if what is good for the individual members, is good, or should be good for society as a whole.

Perhaps the greatest of their visionary thinking, after vicious religious persecution that forced the Pilgrims to flee their country, was establishing a State with freedom of religion, or no religion; under these parameters did America become the greatest country to ever inhabit the planet, and scientific inquiry was able to flourish without the scrutiny of the ignorant and vile Church, creating and leading up to advances in medicine, for example, unthinkable a mere fifty years ago.

But as Jews we have the added privilege to have the Torah.

And as Chazal tell us, we didn't really want any rules. We were content initially, (before the Torah was forced on us), to worship false idols, many gods, Golden Cows, any cow, and Edward G. Robinson --- [born Emanuel Goldenberg; עמנואל גאָלדנבערג (Erev Rav - Cecile B. DeMille's version)] --- style leaders.

Leaders that lied to us, wreaked havoc on our value system, caused dissension among the desert nomads we once were, and guilty of every human weakness and acting out on that failing. Hashem, after offering His Torah to the rest of the nations, and being turned down, forced us slaves and nomads to accept the Torah, the literal and the implied, or he was going to lift up Har Sinai, and crush us to death. We were ingrates. Nothing He did earned our trust or respect. We acted like sub-humans regardless of all the chesed that He bestowed upon us.

And we are NO better today; you will be FORCED to accept the rule of law and protect our children first under all circumstances!

Our Erev Rav, want to tell us that the societal freaks that plague gentile children, don't plague Jewish children. A mere five years ago, a man who is the spiritual advisor to a whole city in New Jersey, told you publicly, that perhaps"one of those (freaks) slipped through his fingers, but that he/they had the matter under control according to his Torah".

Scroll down to the weekend program!

Rabbi Yisroel Belsky is a featured speaker on Shabbos. Chaim Neuhoff is a co-chair of a session that will discuss safety for your children. Rabbi Kaminetzky is another featured speaker, the man that moved Moshe Eisemann in middle of the night from his Philadelphia Yeshiva to Ner Israel in Baltimore once he confirmed the allegations of Eisemann's raping of boys in his yeshiva. And the bozo that is giving the keynote address Motzei Shabbos has in his kollel sitting today, a man who rapes baby girls in his family, and Shmuel Kaminetzky knows about it. Chaim Neuhoff, under the instruction and psak din of Sruli Belsky, participated viciously and with malice, in the cover-up for Yudi Kolko and Lipa Margulies & Co. (See hazmana below that was intended to stifle Eli Greenwald from speaking to the parent body of Torah Temima about Kolko)

Parents trusted their kids to these types that used their kids as "objects" - either making money off of them in their schools, summer camps, seminaries etc., and as we now know, that in every yeshiva and girls school, many kids were sexually, physically and emotionally abused by staff members, principals, teachers --- and these crimes were covered up by criminal circus midgets with long beards, like the ones sitting at your dais here tonight.

I look around this room and I know many of you; I find it incredible to believe that you are here showing support for this criminal enterprise. In effect, you have created "a race to the bottom" of what was once a beautiful heritage and tradition. Have you no shame? What will your legacy be, if not leaving the world a much worse place than how you found it? Your kids are ashamed of you --- and are voting with their souls, hearts and feet "out of here!"

Who do you think you're kidding? They see through you! They know that there's not a darn thing about your lifestyle that they want to have anything to do with!

Hashem had sent His messenger to America in September 1913 to set up shop with a model that would work for American Jewry. And a model that was mostly foolproof until the end of time. Children were to be cared for and loved by how you educated them and protected them from evil forces, within and outside our community. They were to be first and foremost bnei Torah in all its glory. Being a mensch was not optional! They needed to spend most of their school day with model rebbes/humans... not some garbage can with a lid that the sanitation department would refuse to pick up!

They needed to be educated as proud Americans, with full knowledge of most every subject taught in American secular schools (at the time). They needed to understand that they would one day need to go out in the world and either be a proud supporter of Torah institutions, or become a member or founder of a Torah institution. There was no gray area;... in order to support Torah, you had to appreciate what you learned as a child. And you had to love it, not loathe or fear it! In order to "stay in chinuch" you had to excel in your abilities, in your emunah, in your middos, and wisdom of the printed Torah and its spirit. And that required that you had to give up the so-called good-life, "without ever having to say you're sorry!" There had to be mesiras nefesh, knowing that your ben Torah neighbor that has gone to work, may have a nicer car than you.

Look at you! Look at what you have become! Either felons, or felons that have not been caught yet!

You trusted your kids to lowlifes, degenerates and perverts! They'd sell you down the river in a second, the second you stopped giving them money, or not as much as they wanted from you! And then your kid would be out on the street too, because he "did not measure up"! Which guy at the dais here has to be concerned about mundane issues like paying their mortgage, or tuition? Do they even have a mortgage? Or was it paid off with your money combined with whatever they could steal from Uncle Sam?

So why are you here?

There was a reason that Dr. Joseph Kaminetzky was appointed the head of Torah Umesorah. He graduated from Columbia University and had the wisdom needed in every area of education, and was rightfully in charge of the curriculum in each and every Torah Umesorah affiliated school.

It was no coincidence that Dr. David Stern was selected as menahel/principal of Yeshiva Torah Vodaath. He too was a graduate of Columbia University and a rabbi at one of the early Young Israel synagogues.

And when Rabbi Alexander Linchner z"l left his position at Mesifta Torah Vodaath to focus full time on the building of Boys Town Jerusalem, he hired Rabbi Moshe Lonner PhD, to be the high school secular studies principal; with the same intent, gusto and spirit that his father in-law had in appointing Drs. Kaminetzky and Stern to their respective positions.

So how did we get here? What group of ignoramuses led us down this path of "the more ignorant, the more uneducated, the more dumb" -- the better? "Where are the lomdim?" an ultra-orthodox rabbi recently bellowed! Where are the Torah scholars?

What have you done to your kids and their kids?

Go back to the original model set up by Hakodesh Baruch Hu Himself; pick the few select students to toil in Torah, to stay in chinuch, and to be a model for your grandchildren. Get rid of the gangsters running the American yeshiva system and its affiliated organizations -- they have already destroyed two complete generations.

You will hear from the likes of psycho misfit Avremel Schorr, who will tell you the "dangers of the new technologies". "GET RID OF THEM" - he will hyperventilate! And I say...it's here to stay and only in the developmental stages --- you must educate your children with love and patience about the appropriate uses for these devices....BANS DO NOT WORK and are the products of sick and ignorant minds!

Supporting Agudath Israel in any way, will only encourage them to continue to run a parallel justice system to shield themselves and their institutions from illegal and nefarious conduct --- with total disregard and abandonment of societal protections that we must have in place for the safety of our kids, ourselves and our Jewish families. You saw what transpires under the bais din system run by these very criminals.

And finally...

My advocacy for the causes that are close to my heart are who I am, proudly. I have no other motive other than to see the betterment of all of humankind. I am a product of an illustrious family and upbringing, and would have preferred to do my work anonymously - as a true chesed shel emes, in the realm of a mes mitzvah. Those that I work with, know I spurn the spotlight, have distributed my own funds to the necessary professionals and costs associated with protecting kids, under a pseudonym, and postmarked from cities that I hoped could not be traced back to me. My father and grandfather sat in the back of the shul as I do. That was not meant to be - but the only "being" that I will explain it to when the time comes, is THE "Yodea Machshavot" - but of course, He already would have known that.

The UOJ Classics - March 1, 2008

I wanted to know that in fact I had made a difference for the better of Judaism, for Jewish children, for children the world-over, and for people everywhere of all faiths and no faith, to understand that there is right and wrong, good and evil.

I was more than willing to give up my "successful career" as a Jew who happens to blog, rather than a blogger who happens to be Jewish --- for a new and improved Judaism - where rabbis really understood the seriousness of their deplorable conduct and fessed up. I care! I love Judaism! Without hesitation - I would die for the values I believe in! I know that we deserve better. We have been lied to by evil scoundrels without scruples! They took our beautiful heritage and turned in to a cult for peasants. I despise them and what they did, and if they died in the street, I would step over their dead bodies and not even call the morgue - chevrah kadisha!

Judaism is an ever evolving work of art - designed and painted by our Creator - at least it was. Every nuance was beautiful and destined to be a model to the world. We were envied - for the Judaism of unlimited beauty, our value system, our traditions, our holiness ---and then - oh yes - there's a big but(t) - enter "Gedolim" - pathetic ignoramuses who know nothing about human behavior, nothing about affairs of the world, nothing about the needs of our people, totally unschooled about our psychological make-up, know nothing about the needs of our children, care about nothing - other than themselves - who until today are proudly protecting child-rapists --- and then taking control over a Judaism we were once so proud of! They are destroying your lives and those of your children - with their distorted and ignorant world-view! The kollel crisis...will destroy your families. The lack of secular education - will destroy your children! The "singles" crisis - will get worse! The child-rapists crisis is going un-addressed - except when one gets caught by the Authorities - after all kinds of cover ups!

I would have gladly gone away....if.....

1- The rabbis would have admitted they have failed our children and our families by permitting scores of child rapists to have access to our children. And that they would have seriously addressed the issue in a meaningful manner...including active police involvement --- like human beings would!

2- Address the crisis --- of the future of our children - not being educated, not enabling them to be able to support themselves and their future families.

3-  Understanding that the vast majority of shalom bayit problems are caused because there is no parnassah - and kollel is a huge part of the problem!

4- The financial rape of our middle and lower income families - by schools that will unofficially blacklist children - simply because their parents are not affluent!

5- The kashrus crisis of bogus hashgachas and intentional fraud - by many more --- the likes of Moshe Finkel - who for at least a decade - sold non-kosher food to thousands of "kosher" consumers. It was not like this guy was Modern Orthodox or something - Rachmana litzlan! Beard, payos, bekisher - kids in Brisk and Lakewood -the whole Charedi nine yards!

What do we get - an urgent call to action - to ban a concert - and cause massive financial damage to an untold number of innocent bystanders! You beg the world to laugh at us - for the same reasons we mock the Islamic-Fascists! How could you do this - as the entire world is pointing at us Jews and are saying - "we told you these Jews are despicable people - they rape their own children!?"

You don't like concerts for your insane twisted reasons - for Heavens sake - sit down with the producers, organizers and entertainers and speak with them! Give them notice! Ask them to abide by your seventh century - throwback - Taliban-like - world view. Give them a chance to "fix" their "sinful" ways! Who do you think you are - destroying lives and causing suffering - without a darn phone call to anyone? You are not human! You are seriously disturbed! You are mentally and emotionally impaired! Retire - you criminals - before you do any further damage to us innocents!

I HAVE NO MORE TIME TO CHASE RABBIS AND JEWISH CHILD-RAPISTS AROUND THE GLOBE AND BRING THEM TO JUSTICE! I HAVE MORE REQUESTS FOR ASSISTANCE THAN I HAVE THE TIME TO HELP! YOU "RABBIS" HAVE DESTROYED OUR CULTURE! YOU HAVE INFECTED US WITH YOUR IGNORANCE! GO AWAY! LEAVE THE JEWISH SCENE! LET A NEW AND HEALTHY MINDED GROUP TAKE OVER! HOW WILL YOU ANSWER YOUR CREATOR - WHO YOU WILL HOPEFULLY BE MEETING SHORTLY?

I HAVE BETTER THINGS TO DO WITH MY PRECIOUS LIMITED TIME THAN TO CHASE GANGSTERS LIKE YOU - BEGGING YOU TO ACT LIKE JEWS - NEVER MIND RABBIS!

So I'm staying around - and will mock you forever --- until the next, new generation takes over - hopefully with a normal and healthy understanding of what a rabbi should look and behave like!

Do me something - I love Judaism and will attempt to fix whatever I can, in any way I can - with every ounce of strength and God-given talents - even if it takes me the rest of my life!

The Enemy Within - Part Two - The Evolution of Right Wing Fanatacism

The Enemy Within-Part Two-The Evolution of Right Wing Fanaticism

There are four separate catagories of movements that constitute right wing Judaism in the U.S.A.

1- Yeshivishism
2-Chassidishism
3-Agudah/Lobbyism/Government Activism.
4-Boro Parkism/Flatbushism

There are overlaps in ideology or lack thereof between the above groups. The tzad hashava (common denominator) between all of them is money and power.

This blog will focus on category one, or Yeshivishism.

The Yeshiva" movement", as we know it today, began after World War Two. Of course there were yeshivas around before the war, but it was not a" movement", it was a place to get your child educated.

There is a huge difference between the two.

One of the main differences is that before the war the yeshivas were institutions, run by board members and not by individuals. Certainly the heads of the yeshivas were where the board members looked for direction, but ultimately, and sometimes after great battle, the board rendered the final decisions.

Rabbi Aron Kotler (RAK), was the first yeshiva head to turn yeshiva education into a movement. That means he had absolute total control of everything.

Yes, he had baalei batim that supported him financially, but they had no say in anything at all other than the mundane issues of dinners, housekeeping etc.

Do not let anyone fool you, NO BAAL HABAYIS HAD ANY SAY AT ALL IN THE RUNNING OF THE YESHIVA. It was his way or the highway. If you dared to condradict his philosophy, there was no tshuva, you were history.

He was on a mission to replace the lost Torah scholars of churban Europe, a very noble, and what most people believed was an unrealistic task. While an extremely worthwhile project, it was not what people are now calling that idea, an idea of "genius."

Many refugees had the same idea. To name a few; the Rebbes from Satmar, Klausenberg, Rabbi Y. Kaminetzky, Rabbi Y.Ruderman, Rabbi M. Feinstein and probably twenty to thirty other prominent refugees from churban Europe.

What made RAK's idea a bit more novel was his concept of Torah Lishma. That meant that his yeshiva was to enroll anyone that wanted to learn Torah exclusively, there was not to be any other considerations about secular education or any education that would teach one a parnassah..etc., outside the world of Torah.

The yeshiva and Hashem would provide.

Money was hard to come by, but RAK was a super salesman, he had a niche product, a salesman's dream. He believed in his product and targeted every single Jew with a conscience and money. He played on the Holocaust; which resulted in the demise of most of Judaism, and the death of most European Torah scholars.

To use a tired but appropriate cliche, he was in the right place at the right time.

His customer base was broad, comprised of the bright yeshiva students with a future in chinuch, to the yeshiva boy who had nothing else to do but to go out and get a job. All were welcome. Naturally, every boy that came into the yeshiva had family and extended family that RAK approached for funds.

Slowly but surely not only did he encourage his idea of Torah lishma exclusively, but he was beggining to claim that all other ideas of learning Torah in conjunction with any other learning was against halacha.

He treaded lightly at first, but before his death in the early sixties, HE CLEARLY DENOUNCED ANY OTHER YESHIVAS THAT PERMITTED THEIR TALMIDIM TO PREPARE FOR A PARNASSAH WITH ANY FORM OF STUDY OTHER THAN TORAH EXCLUSIVELY, AS APIKORSUS AND RISHUS. NO EXCEPTIONS. He used outlandish and very descriptive language to make sure his ideas were well understood.

He passed on, and his ideas were used by his students as a springboard to what became Yeshivishism, or right wing fanatacism.

The primary yeshiva to promulgate this new trend was the Philadelphia yeshiva led by Elya Svei and Shmuel Kaminetzky. Svei, a noted and erudite talmud chochom, was well known for his kannaus or intransigence.

There was another side of him which was generally unknown, and that was his desire and goal to control the Yeshivish movement singlehandedly, after RAK's death. Kaminetzky, not nearly as bright, but realized he would make a good front man, did just that. They created the first Ivy League yeshiva. They made it difficult to get in, unless a student was very bright or of course there was money in the family.

In a relatively short period of time, their campus was built with state of the art facilities, and they had no mortgage.

Svei was free to wander off to head Torah Umesorah, and ultimately almost brought the Jewish day school movement to the brink of disaster with his outrageous and outlandish nonsense. What played in New York, did not play well in Peoria. He did not get his way and was forced to leave. He tried his shenanigans at the Agudah's Moetzes, and again was marginalized, until he left the organization.

His students idolized him, although it was clear to any rational observer of the Jewish scene, that he was losing it, and doing way more harm than good. His speeches were long and rambling, and his message was hard line, irrational and incoherent.

Nevertheless, He solidified RAK's ideology of Torah lishma, where it now became shameful for anyone to ever consider doing anything other than becoming a lifer(kollel for life.)

Easy for him to say, he now had a multi-million dollar campus paid off completely, and a student base primarily of wealthy kids. He did not take in any Iranians or Russians until he was absolutely shamed into it. Nice guy!

Shneur Kotler, RAK's son, took over the reins at Lakewood. He was a simple guy, and was not a Torah scholar of stature. There were rumblings and discontent over his automatically being named rosh yeshiva, but the antagonists were quickly dealt with by removing them from within the yeshiva.

This was the first time in the non chassidic world, that a yeshiva was turned over to a non-qualified family member. All the other major yeshivas at that time, upon the death of their rosh yeshiva, picked the rosh yeshivas from the best qualified candidates.

G-D fearing Jews understood the yeshiva did NOT belong to them, they were doing Hashem's work, and therefore the yeshiva belonged to the klal and NOT their family.

An ugly and dishonest precedent was set, and the uncouthed tigers were out of their cages.

Shneur Kotler evolved into a charismatic fundraiser. He inherited a well-oiled machine, and worked real hard. A confluence of factors caused the "movement" to grow geometrically. The onset of the Vietnam War, the Baby Boomers and the seeds of serious financial wealth in the Orthodox community, were very definite contributing factors to this astonishing growth.

By the time that Shneur Kotler passed away in the early eighties, the cultish concept of going to Lakewood was solidified. ANYONE could park himself in the yeshiva with no supervision, and stay as long as they felt like it.

Again, the yeshiva (or rather Shneur's wife), put at its head a way below average Kotler, her son Malkiel, and for window dressing they titled other relatives with meaningless positions.

The Kotlers had their dynasty with access to millions of dollars of the public's money, as well as millions of dollars in questionable government grants. Until today, no person can dare enter the yeshiva without filling out a government assistance form that goes directly into the Kotler coffers.

The common denominator between the greatest advocates of learning for life, are TWO FAMILY OWNED INSTITUTIONS WITH TENS OF MILLIONS OF DOLLARS IN REAL ESTATE UNDER THEIR FAMILY NAMES.

Elya Svei and Shmuel Kaminetzky have their imbecile kids running the yeshiva, while Kaminetzky is globetrotting and Svei is at home hallucinating.

The two Kotler brothers have under their direct control and legal title to approximately one hundred million dollars in real estate, in addition to millions of dollars a year in gross income from the public and the government.(in many cases bogus programs)

In summary, these two institutions, by claiming that it is forbidden to get a secular education in order to feed one's family, have no risk of going hungry themselves. They are charlatans of the first order.

Rabbi Yaakov Kaminetzky had advised some of his premier talmidim that it was in their best interests to get a college education. Rabbi Hutner encouraged college education for individuals with no interest in earning a living in chinuch, and was himself college educated as well as his daughter Bruria David. In addition, the two above great rosh yeshivas DID NOT PASS ALONG THEIR YESHIVAS TO THEIR FAMILY.

My point is this.

The dishonesty of preaching a philosophy that will bankrupt families and create so much misery for generations, must come to an end.

The Chofetz Chaim ran a grocery store.

It is not shameful to take care of your wife and children,it is shameful not to. To hell with the Sharptons and Jacksons with beards and black hats.

When you start living in two room apartments and have no money for food, give us a call. Until then, stay far away from our gullible kids.

To the idiot financial backers of these fraudulent money grubbing hucksters, stop being accomplices to the greatest crime to hit our community in recent memory.

Any religious sect that imposes crippling taboos on healthy sexual interaction between adults will inevitably breed a culture of sexual abuse and perversion.

 Judaism’s fundamentalism problem

  •

John Mahoney / Postmedia News

When I speak to Jewish audiences, I often am asked about the “double-standard” that exists in the media. Israel, they complain, is held to a higher human-rights standard than any other country in the world. And they’re right.

But in another respect, Jewish communities — both in Israel and the Diaspora — sometimes are held to a lower standard. Despite emerging evidence of widespread, appalling sex abuse within fundamentalist orthodox Jewish communities, this problem gets only sporadic attention, especially compared to the massive media onslaught that accompanied the Catholic sex-abuse cases that have emerged since 2002. In part, this is because Jewish whistleblowers are shamed, harassed and effectively excommunicated. In the New York City area, where North America’s fundamentalist Jewish sects are concentrated, local politicians and prosecutors have been pressured to ignore the pleas of abuse victims, lest they bring dishonor to their communities.

The Catholic Church hierarchy once approached the problem of abusive priests in the same unconscionably negligent way. But the scandals of the last decade have forced it to change. Reporting protocols have been put in place, and pedophile priests are no longer simply shuttled around from posting to posting. With few exceptions, no such reforms have been put in place in fundamentalist Jewish communities: Too many local rabbis still try to hush up pedophilic sex crimes and discourage investigation by outside authorities. (This summer, a Montreal Orthodox Jewish religious court informed families that children should tell a parent or rabbi if they have been sexually molested at school or camp, which counts as progress. But the court pointedly neglected to instruct parents of their obligation to report serious incidents to the police or youth-protection officials.)

Last week, in Brooklyn, the NYPD Special Victim’s Squad arrested an ultra-Orthodox Israeli rabbi — Yakov Yitzchak Roth, of the Hasidic sect Shomrei Emunim — after it was discovered that he’d neglected to report on his U.S. visa application that he’d just served a 16-year Israeli sentence for sodomizing a child relative. This is just one of many troubling cases served up by Brooklyn’s Hasidic community in recent years. Others include Baruch Lebovits, a Hasidic cantor whose 2010 conviction on eight counts of molestation recently was overturned on technical grounds (he likely will be retried in 2014). Lebovits’ sexual habits reportedly were widely known in his community for years. But the state prosecuted him only after a Hasiddic whistleblower, Sam Kellner, went public with claims that Lebovits had groped his son. For his troubles, The New York Timesreports, “Kellner found himself denounced on the street and barred from shul [synagogue]. His business suffered; [and] he pawned his silverware last year.” (Kellner also has been embroiled in his own protracted legal saga, whose details are too complex to summarize in this space.)

Another whistleblower is Rabbi Nuchem Rosenberg, who once was a leading member of Brooklyn’s Satmar community (a particularly backward-looking, anti-Israeli, patriarchal strain of Hasidim), but has since been exiled because of his activism against what he describes as rampant pedophilia within the Satmar community. (In 2012, he was attacked outside of a fish store by a fellow Hasidic community member, with a glassful of what he believes was bleach.)

The New York Times, to its credit, has published some useful reports on Kellner, Rosenberg, and the few other whisteblowers within the Hassidic ranks. But in general, the media coverage is a pale shadow of the front-page bombshell treatment that every new Catholic sex-abuse revelation got. Many Jewish journalists feel a misguided Fiddler-on-the-Roof sentimentality toward fundamentalist Jewish communities, and non-Jewish journalists often are scared off by the task of investigating groups that seem hostile and cultish to outsiders.

But not all journalists have been scared off. This month, Vice.com ran a lengthy interview with Rosenberg, in which he described an appalling scene from a ritual Jewish bathhouse in Israel, where child-rape is, by his report, a tacitly accepted practice among some of the older men.

“Rabbi Rosenberg believes around half of young males in Brooklyn’s Hasidic community … have been victims of sexual assault perpetrated by their elders,” Vice.com reports. “Ben Hirsch, director of Survivors for Justice, a Brooklyn organization that advocates for Orthodox sex abuse victims, thinks the real number is higher. ‘From anecdotal evidence, we’re looking at over 50 percent. It has almost become a rite of passage.’ ”

“Ultra-Orthodox Jews who speak out about these abuses are ruined and condemned to exile by their own community,” Vice.com’s Christopher Ketcham adds. “Dr. Amy Neustein, a non-fundamentalist Orthodox Jewish sociologist and editor of Tempest in the Temple: Jewish Communities and Child Sex Scandals, told me the story of a series of Hasidic mothers in Brooklyn she got to know who complained that their children were being preyed on by their husbands. In these cases, the accused men ‘very quickly and effectively engage the rabbis, the Orthodox politicians, and powerful Orthodox rabbis who donate handsomely to political clubs.’ The goal, she told me, is ‘to excise the mother from the child’s life.’ Rabbinical courts cast the mothers aside, and the effects are permanent. The mother is ‘amputated.’ One woman befriended by Dr. Neustein, a music student at a college outside New York, lost contact with all six of her children, including an infant she was breastfeeding at the time of their separation.”

Western Muslims, in particular, might be especially curious why there is not more attention paid to these Jewish fundamentalist practices. Whenever some controversy emerges over the cloaking of women or the disparagement of “infidels” by fundamentalist Muslims, I often receive emails from right-wing bloggers claiming that this is but one step on the Islamist path to the complete Sharia-fication of North American society. And it is true that an obsessive patriarchal domination of women, especially in the public sphere, is a hallmark of retrograde interpretations of Islam. But the same goes for fundamentalist Judaism: Any religious sect that imposes crippling taboos on healthy sexual interaction between adults will inevitably breed a culture of sexual abuse and perversion.

Which brings us to the profoundly creepy tradition by which women in extreme Hasidic communities are expected to shave their heads, and live out their married lives as bald women, in deference to an absurd interpretation of Jewish scripture. Earlier this month, a brave female exile from the Hasidic community in New York, Frimet Goldberger, went public with her disgust at this practice. The most memorable part of her account comes when she describes her meeting with the Va’ad Hatznius — a sort of Taliban-like Committee of Vice and Virtue that purports to judge God’s will in regard to female modesty — after word had spread within the community that she secretly carried an unshaven head of hair under her turban. During the entire proceeding, the chief of the group kept his right hand in front of his eyes, to shield himself from Ms. Goldberger, lest he contaminate himself visually with her wanton harlotry, and directed his comments only to her husband. In a move straight out of Saudi Arabia, the Va’ad Hatznius indicated that it would soon be spending a female inspector to Goldberger’s house, to examine what lay under her turban.

What’s worse, her son was being expelled from the local Jewish education system: A letter arrived indicating that he was being thrown out “because of my failure to dress in accordance with the stringent [modesty] rules of the holy shtetl.”

That was five years ago. “Many lifestyle changes and adjustments later, I no longer cover my hair as many of my Orthodox peers do, and I am no longer capable of accepting, let alone understanding, the practice of forced head shaving, much less the threats and intimidation used to maintain it within the community,” she now reports. “But I am grateful for the fact that this very last, most personal violation of mine led my husband and me to gather the strength to take control of our lives and to make decisions for ourselves, our children and for me — my own body.”

Both Montreal and Toronto have Hassidic communities doctrinally connected to their counterparts in New York and Israel. The rules of public life among these groups often is dominated by Rabbis held who become de facto cult leaders, prompting vicious propaganda struggles and excommunication campaigns. In the Quebec community of St. Agathe, Lev Tahor, a small cult-like group of fundamentalist Jews led by an eccentric rabbi (and convicted child kidnapper) named Shlomo Helbrans, has been dogged by abuse claims for years. (In fact, according to The Times of Israel, members of the group left their compound this month out of fear that their children would finally be removed from their households.)

“Members who have left the group described a diet of dough, goose eggs and goat’s milk, but no fruits and vegetable,” the newspaper reports. “There are regular beatings, long prayers, and for the girls, dark clothing covering all but the face, and household servitude. Children, including babies and toddlers, are removed from their parents to live with other families, often repeatedly. Girls are routinely married off at 14, in some cases to men more than twice their age … Tahor’s written regulations describe women as disgusting and deserving of isolation and a subsistence diet. A husband may hit his wife for disobeying the ‘rebbe’s’ teachings.”

Since the dawn of modern feminism, social liberals have sought to liberate women from the clutches of conservative Christian doctrines that keep them under their husbands’ thumbs. Since 9/11, a similar project has been underway in regard to Muslims. It is time to take a broader view toward this project. All patriarchal religious traditions that make a fetish of separating the sexes, that entertain phobic and repressed attitudes to human sexuality, that privilege group solidarity over the well-being of children, and that treat women as debased creatures who cannot be trusted to walk among us, except under wig or veil, must be subject to the same scrutiny.

"We're not teaching our kids how to protect themselves," Gross said, advising parents to start when children are 2 1/2 years old. "Tell your children that most people are good but you might have one who is not," she said. "Teach safety skills," Gross said. Tell children, "Say no, right away, tell your mommy."

Debbie Gross of the Crisis Center for Religious Women in Israel, discussed sexual abuse in the Jewish community before an audience at Chabad Central of Boca Raton

Debbie Gross, founder and director of the Crisis Center for Religious Women, a 20-year-old organization that provides emotional support and counseling to victims of sexual abuse (including men, boys and girls) in Israel, was in South Florida last week to talk about sexual abuse in the Jewish community and to reach out to Jewish schools to provide training for teachers and students.

During a presentation at the Chabad Central of Boca Raton, Gross talked about how parents can keep their children safe.

Sexual abuse is an epidemic and people are realizing it happens in the Jewish world, she told an audience composed primarily of women. We need policies and programs in schools and synagogues, Gross said. "The idea is to find a way to keep kids safe; to be aware ourselves."

She urged members of the audience to "Take your communities back."

"We're not teaching our kids how to protect themselves," Gross said, advising parents to start when children are 2 1/2 years old. "Tell your children that most people are good but you might have one who is not," she said. "Teach safety skills," Gross said. Tell children, "Say no, right away, tell your mommy."

Gross said she teaches "stranger danger." She explained, "Often we can think our children are going someplace safe and they are not. Think twice about rides, bar mitzvah tutors — any time the child is alone." Boys and girls, Gross added, are at the same risk.

Answering questions from the audience, Gross said parents should teach their children that no one can touch their private parts, on top or under their clothes. "We tell them, 'Any area that is covered by your bathing suit,'" she said.

Camps should have child safety programs and trained counselors, Gross said. There also should be a "safe adult" in the camp — a mother or a nurse — she said.

"We can't make everybody safe," Gross said. "We can make our schools safe. We can make our shuls safe."

In an interview with the Jewish Journal, Gross said she met with rabbis from Jewish schools "across the spectrum" in South Palm Beach and hopes to return in February 2014 to train teachers.

Gross said she also met with Jewish Community Services in Miami last week to arrange for training and reach the Jewish population.

Asked if she met with anyone from the Broward County Jewish community, Gross said she hasn't met with anyone but would be interested in doing so.

Sheri Siegel of West Boca Raton, who identified herself as "a teacher, social worker and a mom," said she went to the Chabad to hear Gross' presentation because sexual abuse is a "taboo topic" and "people don't like to talk about it."

Siegel, who teaches at the Hillel Day School, said the school hasn't trained teachers to deal with sexual abuse.

Parent Eric Aiken of Boca Raton said he asked the Chabad to host the program after he learned that Gross would be in South Florida. "I'm trying to make communities more aware of sexual abuse in the Jewish community," Aiken said. "I think it's much more widespread than people think. It's very much covered up in the Orthodox community."

Sorting Through The Rubble - The Message Is Clear!

    The UOJ Vault - June 2009 - 1,324,564 Views

Don't take my word for it!

Don't believe a word I say - unless I can logically and factually back it up. And the same goes for anyone with a message, any message from any messenger. It's either true and can be established, or it's hyperbole and rabble-rousing by clown-type imbeciles, costume and all, with nothing else to say but "trust me", I know what's best for you, your children and everyone that I/we deem a Torah-true Jew.

This has been the mindset for at least two decades, certainly since the passing of Rabbi Yaakov Kaminetzky z"tvkl. And Rav Yaakov saw this era coming, the era of Yiddishkeit being distorted and shredded by people with absolutely no sense of reality, and the lack of understanding and caring that what was good for the individual, the yachid - was good for the klal - the masses --- and not the other way around.

So, if thousands of kids were herded through a flawed yeshiva system, a system that did NOT care for the individual child, but rather thrived on numbers, and raised funds based upon being the "biggest" yeshiva, with great numbers of kids in their system, the individual - mostly regular great kids, very normal kids that needed unconditional love and attention, would get lost in the shuffle.

Rav Yaakov understood that, Rav Elya Svei did not. The Lakewood gang did not and we are now paying the price; thousands of families that were emotionally forced to engage in this fraud called kollel, are now poverty stricken, and a great deal of them, their parents, and their children paid with their souls. This community induced poverty was a desperate attempt by the Establishment to reel in the masses under the control of a few. If you need organizations and yeshivas to sustain you and your family, who would bite the hand that feeds you?

Entire families are disenchanted with Judaism, not just children. I guess the Agudath Israel can now develop a new government sponsored program -- call it Project NO - and have it headed by one of their own, someone who talks the talk, walks the walk, but when it comes down to the underlying failures of the program, for the inability to comprehend and address the real issues, old and new, he will toe the line of the establishment, rather than standing up for the brutal reality, and those victimized and re-victimized.

It was not that long ago when an acquaintance of mine, a true ben Torah with a large family living in Lakewood, took a chainsaw, and decapitated himself. Other contemporaries of mine have confided in me that they despise what has become of them, and hate waking up in the morning. They have been totally neutered, by them having to rely on their wives supporting them, and regularly signing documents to enable them to receive Welfare in one form or another.

A bright high school buddy of mine died oh so young, by intentionally destroying his body with food and alcohol and God knows what else he consumed to put himself out of his misery. He was not a flunky kindergarten rebbe, he founded and headed a large school.

Another former yeshiva friend, was instructed by his rosh yeshiva to go on a taanit dibbur, stop speaking entirely, until he purged himself from his inclination to gossip and speak loshon hara. He cracked up and spent years in a mental institution. He lives in Lakewood, the last I heard was that he is permanently emotionally disabled.

These are not isolated cases, there are countless horror stories similar to the above that I am aware of.

My educated and informed guess is that Shua Finkelstein in Lakewood put himself out of his misery, because the Lakewood Mafia protected his molester. His molester is part of a family that donates large sums of money to Lakewood - Beth Medrash Govoha. The Lakewood philosophy of dealing with child-abusers in a "respectful and dignified" fashion, in my opinion, played no small role in Shua's death.

It is no coincidence in my mind, that David "Fifi" Zahler, who over the last years developed a close relationship with Moshe Eisemann on the Ner Israel campus in Baltimore, intentionally jumped to his death. Nobody dares to say this publicly, that's why I will.

The System is broken, it collapsed under its own fraudulent weight; the evidence surrounds and envelops you, but you refuse, or are too petrified to deal with this reality!

"Once we could say we didn’t know. Now we know." Borrowing from David Zwiebel's "confession" -- David, we now know as well, you and your organization, Agudath Israel, are pitifully corrupt and morally inept, nobody should be trusting any important life and death issue to you and your cohorts! And that's believing for a brief moment that in fact you now know because you really know or because you were "forced" to know, rather than choose to know. In either case, evidence of sexual child-abuse in Orthodox Jewish schools and camps has been festering out there for some fifty years, including in your own summer camp and in hundreds of your directly affiliated schools, and yet you did nothing to protect these violated children, and did everything to protect the vile child sex-abusers and the criminal, despicable rabbis that protected them.

You all have lost any moral authority on this issue -- and worse, you all deserve to be held criminally negligent and responsible for the thousands of troubled lives and God only knows how many related, self-destroyed lives by children who could no longer bear the pain.

So, I'll have none of your continued lies; when I chose to dig deep into the authenticity of what else you and the likes of you were selling; I became aware of the extent of your involvement in covering up these unspeakable crimes, and I, to my horror, discovered that except for a handful, the rest of you are petty, conniving, mind-thieves without a scintilla of a moral conscience.

The message is so apparent -- none of these rabbis should be able to dictate to you what's in your best interest -- because they are destroying our Jewish heritage to cover up their own crimes, where "d'racheha darchei noam" should be first and foremost; instead they are damning our children and ultimately us, all of us, to an unsustainable and self-destructive life that is causing misery and desperation to the vast majority of Orthodox Jews. We must set up a bulwark that will prevent the espousing of misery as a way of life, foolproof systems of protecting our children, in and out of yeshivas, from those that would destroy them by enfeebling their minds with their self-manufactured religious rubbish, and not protecting their physical and emotional well-being that were entrusted to their care; that not only is the antithesis of everything Jewish, but it is anti-Jewish!

Rabbis and their underlings, that would protect pedophiles and their enablers at the expense of our children and our families -- whether the crime occurred yesterday or forty years ago, must be treated as amongst the greatest enemies that ever faced the Jewish nation.

These rabbis stand stark naked before us -- and it is ugly! They must be taken down!

    A Doctoral Candidate Writes:

The Moral Responsibility Research Project was launched in October 2007. The researchers are graduate students in psychology at the University of Chicago, DePaul University, and Loyola University. The focus of the research was the prevalence and effects of molestation in the Chicago Orthodox Jewish community. Using evidence-based best practices the team set out to research this vital subject.

The following is a sampling of the data compiled to date:

1 in 6 Chicago Orthodox Jewish teenage boys reported being molested at least once.

1 in 5 Chicago Orthodox Jewish teenage girls reported being molested at least once.

    Boys who are victims:
52% reported being molested by teachers
35% reported being molested by a relative
    13% reported being molested by a friend/others

    Girls who are victims:
0% reported being molested by teachers
73% reported being molested by a relative
    27% reported being molested by a friend/others

Who did you report this to?

    57% reported this to parents
    20% reported this to a school/community rabbi
    0% reported this to police
23% reported this to no one

Why didn’t you tell the police?

10% responded - their parents wouldn’t allow it
54% responded - their rabbi doesn’t approve of informing on another Jew
15% responded - they feel guilty about what happened
21% responded - they fear for their family safety, financial stability or prestige

Of those who reported the abuse:

How knowledgeable and accepting was the person you spoke to?
50% responded - very knowledgeable and empathetic
30% responded - knowledgeable but unsympathetic
10% reported - it went right over their head
    10% reported - being insulted

What was harder for you, being victimized or coming forward and talking?

    Boys:

    63% responded - coming forward
    37% responded - being victimized

    Girls:

    13% responded - coming forward
    87% responded - being victimized

Those who did not report the abuse to anyone:

63% responded - it would ruin the prospect of leading the life they desire
19% responded - "Who needs to deal with a mental health worker?"
16% responded - "I must be a terrible person so why tell people how bad I am?"
    2% responded - I don’t know

All victims were asked these two questions:

1] Does God still love you?

    73% responded - Yes
    20% responded - No
    7% responded - I don’t know

2] After what you went through do you still love God?

    23% responded - Yes
    77% responded - No

IN MEMORY OF MOSHE MENACHEM KANOVSKY ZT"L ---

It was at the same time hilarious and loathsome to bystanders. On Friday afternoon, April 13, 2007 (two days after Passover 5767), a 31-year-old ultra-Orthodox lawyer jumped to his death from a 69th-floor office of the Empire State Building in NYC. "Only in New York," said a yokel bus driver, "Only in New York." Visiting tourists dashed to the 33rd street to take pictures of the leg severed below a knee, which sluggish cops didn't cover right away. Theresa Colon, a tourist from Virginia, shrieked: "I cried and got sick to my stomach, I pray he knew who God was."

That lawyer knew who God was. He knew it a lot better than silly southerner Ms. Colon would ever know. I know it because that lawyer was a gifted Jewish scholar and my long time chavrusa at the Ner Yisroel of Baltimore, Moshe Menachem Kanovsky zt"l. I recollect the sleepless nights we spent in Bais Midrash going over and over Gemara with Rashi, Tosafos, Rishonim, Acharonim, and Shulchan Aruch. Moshe Kanovsky polished off many masechtos and knew many Mussar books by heart. Moshe Menachem had really earned his Semicha (the rabbinical ordination).

The New York bus driver was also dead wrong. Not "only in New York." In fact, it started in Baltimore, at the Ner Israel Rabbinical College. And I know it started with rabbi Moshe Eisemann. I reminisce how he would unflaggingly approach Moshe Menachem, I recall that Moshe frequented him on Shabbosos. Was Moshe Kanovsky raped by rabbi Eisemann? I can't say for sure. And I will not make it up about my beloved dead chaver merely to get some people "excited" with the new evidence against gay and pedophile rabbi Moshe Eisemann. But something happened. And it happened when Moshe Kanovsky was a student at Ner Yisroel, and it had something to do with rabbi Moshe Eisemann.

Moshe Menachem suddenly became withdrawn and stopped coming to seder. Through much of the day he slept in his dorm room or listened to Rush Limbaugh's talk show. On one occasion he decided to pour out his heart to one of his rebbeim whom he trusted a lot - rabbi Shraga Neuberger. After that Moshe Kanovsky got even more disheartened. What did "rav Shragi" tell him? I talked with Moshe and his roommates who knew about that conversation. This is the story: rabbi Shraga Neuberger (his shaggy beard still proudly displaying bits of his last dinner) laughed off Moshe Menachem's plea for help and added with an acrimonious wink, "I wonder if you will ever find a shidduch (get married) in your lifetime!" I bear witness that those were rabbi Shraga Neuberger's precise words.

Shortly thereafter Moshe Kanovsky left Baltimore for New York City. I doubt that Moshe went there with an intent to be with his father Yaakov. He was always closer to his mother and siblings who lived in Silver Spring (his parents got divorced in Philadelphia when Moshe was eight). Most likely, he assumed that he would get help from his famed uncle rabbi Yaakov Perlow, the Novominsker Rebbe and head of the Agudath Israel of America. Later I discovered that the Rebbe didn't help Moshe Menachem. Was that because his nephew was less important for "der Rebbe" than his relationship with the powerful NIRC, Agudath Israel, and rabbi Moshe Eisemann? I believe so.

Moshe was an educator, a rabbi, a lecturer, Jack-of-all-religious-trades but not a lawyer. Law was never his passion. He had to go to the Cardozo Law School because ostentatiously holy NYC and Baltimore rabbis with much blood on their hands were afraid of his lofty moral standards and did everything in their power to keep him out of the "klei kodesh" field. They also did an outstanding job to fulfill rabbi Shraga Neuberger's after-dinner "prophecy" ("I wonder if you will ever find a shidduch in your lifetime!"). But anyhow Moshe Menachem spent most of his free time learning Torah and helping poor people in NYC with free legal advice and Torah classes.

I had never been a big fan of conspiracy theories, muckraking, or sensationalism. However, I was wholly unprepared to learn about Moshe Kanovsky's suicide. I knew him well as a highly intelligent, kind-hearted, and soft-spoken soul, who knew fairly well even prior to becoming a rabbi what the Jewish Law warns about suicide, and I doubt he could have done it even taking into consideration possible manic depression / post-molestation effects. Likewise, as stated by the newspapers, all his family and friends didn't notice "any significant changes in his emotional state, even as he started working part-time for an attorney in the Empire State Building."

Many posters on the Internet acknowledged that he didn't jump but was pushed out of the window as it appeared from the security cameras' footage. At first it sounds crazy and distorted, but reason out who was that last "client" whom Moshe saw before abruptly interrupting his meeting with him and going to "another room" to jump out of the window? Why were there wrangling statements from Moshe's law firm denying that he ever worked there? What's more, two days prior to Moshe's death, right after Passover, the Vaad Harabbonim (Rabbinical Council of Greater Baltimore) mailed their infamous letter to the members of Baltimore's Orthodox community on the issue of sexual abuse. Moreover, Moshe Menachem died on the day the Baltimore Jewish Times published its cover story on the contemptible sexual predator rabbi Ephraim F. Shapiro!

Questions. Questions with no definitive answers... We want to rid our religion of child molesters, but we disregard the fact that they are not pure rapists. They deliver inspiring lectures, possess a compelling writing style, raise generations of students, establish important connections. Make an effort to uproot these potentates! The iniquitous child-molesting rabbis groom many disciples wholly saturated with their venom who later occupy positions of authority to safeguard their teachers. A parallel comes to mind with the students of the wicked Balaam (who was a sexual pervert too and, according to Sanhedrin 105b, even had relations with his donkey). Balaam's disciples of today also fit nicely with their definition in the Mishna in Pirkei Avos (5:22) as having "an evil eye,""an arrogant spirit," and "a greedy soul."

A small number of people cover up for rapists because they sincerely believe the molesters were slandered, other craven underlings lick the ass of the mighty and powerful because they are no different than them. We know that a person who is a sexual predator or enabler flouts his own religious doctrines. That's the reason the Agudath Israel is a cringing supporter of all Catholic bills - the people whose ancestors were systematically tortured to death and burned at the stake by that very Catholic Church itself!

Eisemanns are covered up by hobnobbing Ner Yisroel and Baltimore Mafia leaders because they are one and the same: all of them need to live in luxury edifices, take expensive vacations, and be "respectable." Learn from the Agudath Israel! That name means "a bundle" or "a bunch" in Hebrew. In truth, they do work like a bunch of thugs. We also need to group together. Until that happens, we will be ignominiously defeated every step of the way! Firing single email shots from behind your browser can't help a great deal. We need to establish an incorruptible, powerful, and brave organization outside the Internet. We need a place to go to where we will never be betrayed by our leaders who are in reality self-appointed narcissistic cowards!

Until that happens, we will be doomed. What happens when you speak up in Baltimore against the "religious" atrocities of explosive, disgruntled, but still "infallible" leaders, who effectively hold all power in their hands? You will be chased out of all shuls by their NIRC-dependent bellowing from the pulpit mealy-mouthed rabbis, ostracized by the indignated and held in thrall to the establishment "community," get threats in the mail, and face mud-slinging and character assassination. You will be forced out of town like rabbi Eliezer Eisgrau's daughter who was molested by her dad. Because at this point in the real (not virtual!) world only these criminals have the real dominance.

The gist of Passover is freedom. One very unwell person on the Internet made a crafty calculation that Moshe Kanovsky was falling down from the Empire State Building for 4.9254203994149455 seconds. It's really irrelevant if Moshe Menachem jumped himself or was plunged by mobsters, because we know who is responsible for his death, which in actuality started many years ago at NIRC. But I believe that in those final five seconds of his short bright life he (like the Jewish children in the days of the Talmud who jumped off the Roman ship to drown themselves in order to escape molestation) was really free. Free from rabbi Moshe Eisemann's sexual improprieties, free from rabbi Shraga Neuberger's sardonic laughter, free from his uncle's hypocrisy. Free from that heinous tinged with cynicism lie that we now call "Orthodox Judaism," which is in reality inimical to every single thing the Torah-true Judaism stood for all the erstwhile generations of our pure grandparents. And those five seconds of freedom were worth an entire life in this world.

If Mahoney truly believes in Hell, then he knows that's where he's headed. God does not forgive pederasts and their protectors, confession or not.

His enabling of those priests and then hiding them from punishment makes him as guilty as if he were touching those innocent boys' penises himself.

You're going to burn, Roger, and an endless number of people will rejoice at your pain for all etermity.

Angered by church sex abuse, readers turn against Cardinal Mahony

During the Roman Catholic Church's decades-long sex abuse crisis, then-Los Angeles Archbishop Roger Mahony went to great lengths to keep law enforcement uninvolved. Instead of handing priests accused of abuse over to police, he would send them to therapists he knew could keep a secret or to faraway rehab programs. Under his watch, the church discouraged abuse victims from talking to authorities.

That's according to The Times'two-part series Sunday and Monday on the 23,000 pages of documents ordered released by the courts that detail Mahony's efforts to keep accusations of abuse in the Los Angeles Archdiocese from erupting into a public scandal. The stories portray Mahony, who retired as archbishop in 2011, as a politically active prelate whose behind-the-scenes maneuvering to cover up the abuse stands in stark contrast to the image of social consciousness he projected in public.

We've received more than two dozen letters on the series so far, and only two have defended Mahony. Some of the letters are from Catholics disgusted by their leaders' conduct; a handful come from readers who say they've been abused themselves.

The reaction to Times articles on abuse in the church hasn't always been this one-sided. As the scandal unfolded through the years, a good portion of the letters we received accused The Times of being too harsh on Mahony or of harboring an anti-Catholic bias. They said the cardinal possessed many redeeming qualities or did more than most bishops to rid his parish of sex abuse.

Lately, however, readers increasingly seem to see the scandal as singularly defining Mahony's legacy. Here is a selection of their letters on The Times' latest articles.

Dan Milchovich of Covina checks Mahony's ego:

"So Mahony is now being divinely called to 'something deeper,' a public display of personal humiliation rather than serving his faith in humility. Only someone as ego-driven as him would assume that the wreckage done to the lives of others, in which he was the critical enabler, was divinely orchestrated as a personal blueprint for his own redemption.

"The humiliation and pain endured by others were simply props in his own grand plan as devised by his creator. So it was all about him from the beginning."

Michael Ryan of Los Angeles reflects on his own memories of abuse:

"Whether the memory of my clergy molestation is too rusty or simply too embarrassing to acknowledge to friends and family, I had chosen, as I'm certain many have, to remain mute about the incident. "However, thanks to the media and especially The Times, I do feel relief to see Mahony and others complicit in the scandal receive their lumps. This reminds me of a teaching learned in the great Catholic tradition regarding punishment: In the end, the devil too must pay his bill.

Mary Dispenza of Bellevue, Wash., a victim of abuse, says the church is in big trouble:

"As a victim of child abuse at age 7 by Father George Neville Rucker in 1947, I am aware of the cover-up and betrayal caused by Mahony.

"Many of us may be guilty bystanders, dismissing, protecting, turning a deaf ear and blind eye to the most devastating tragedy and era of the Catholic Church: priest sexual abuse of children and cover-ups. Even our present Pope Francis, hailed for his love of the poor and preaching the gospel, has said very little to the victims of priest abuse.

"In my opinion, as long as Mahony remains a 'priest in good standing,' and Pope Francis and the community avoid addressing the issue of priest abuse, the church remains in serious trouble."

Virginia Uribe of Pasadena indicts Mahony with a Bible verse:
"After reading the two-part series on Mahony, I could not help but reflect on a proverb I heard long ago from the good nuns: 'Pride goeth before destruction, and a haughty spirit before a fall.' (Proverbs 16:18)."

Cay Senhart of South Pasadena says Mahony still doesn't get it:
"It seems that to the tragically flawed Roger Mahony, nothing has ever been not about him. Even at this late and mournful stage of the destructive debacle for which he is responsible, his hubris knows no bounds.

"As Mahony himself observed, he could have escaped to the contemplative isolation of his cabin in the Sierras. He should do just that and commune -- perhaps for the first time -- with the concept of Christian humility.

"Those who have suffered from Mahony's ego-driven moral dysfunction are legion, and he still doesn't get that it isn't about him."

"We'll physically give him beatings," Belsky said in Yiddish, according to Amsel.

The beth din was held at the Yeshiva Torah Vodaas in Ditmas Park. Among the several men present, according to Amsel, were Rabbi Israel Belsky, who taught a class at the yeshiva;Rabbi Martin Wolmark, a respected educator from upstate; and Mendel Epstein.
Belsky told Amsel that Rubin had already missed a hearing in December. Because Rubin again failed to show up, Amsel recalled Belsky saying, he'd be tried in absentia and the judges would authorize the use of force to secure a get. "We'll physically give him beatings," Belsky said in Yiddish, according to Amsel.
The October 1996 assault left Rubin bruised and bloodied. A passing motorist saw him and took him to the police station, where officers removed his handcuffs and transported him to a hospital. As he recuperated, Rubin set out to compile evidence against the men he suspected were behind the attack.
He had an associate make phone calls to some of the men involved, posing as a rabbi claiming that Rubin had contacted him to try to have the get reversed. The caller made it clear that he had no qualms with the kidnapping, and that he was simply hoping to confirm that the get was valid. Rubin's friend Barry Markowitz later filed an affidavit stating that he set up a voice-recording system and listened in on the calls.
On November 16 and December 10, 1996, a "Rabbi Wieder" made calls to Belsky. In a transcript of the conversations, translated from Yiddish to English and later filed in court, Belsky describes what he knew about Rubin: "We heard this person is such a rotten animal that there is no equal on this earth." Belsky goes on to explain that he and other rabbis held a tribunal and "the verdict was that there should be compulsion." He stresses that he was not present at the beating but says, "I was in agreement, after many weeks and weeks of consideration and discussing the compulsion itself."
"If he deserves the beatings, then he deserves it," the man masquerading as Wieder responds. "You felt that he deserves it, then good."
"Yes, it's very hard on my heart,"Belsky replies. "I don't keep a record, but it was the first time which I have agreed to such a thing." (Belsky, who denied in court having participated in the attack, did not respond to interview requests from the Voice. Neither did his lawyer,Robert Rimberg.)

Bad Rabbi: Tales of Extortion and Torture Depict a Divorce Broker's Brutal Grip on the Orthodox Community
    Brian Stauffer

This much Abraham Rubin knew: He was lying, blindfolded and handcuffed, in the back of a van. He could feel it winding through the streets. He figured at least three men were in there with him, plus the driver. There was the one who'd stepped out of nowhere and punched him in the face as he walked down 56th Street in Brooklyn's Borough Park neighborhood just a few minutes earlier. And two, maybe three others who'd bull-rushed him and threw him into the van.

"He says he is the undertaker of failed marriages," says Gordon. "The relationship dies; someone has to bury it."
"We only want you to be a Jew," one of them said in Yiddish.
The van stopped. Rubin heard a door open and the men getting out. "The rabbi is coming," one said. Then the sound of two or more men climbing in beside him.

One asked Rubin in English to repeat what he was about to say.

"On the fourth day of the week, the 10th day of the month of Heshvan in the year 5757 in the creation of the world . . ."

It was the beginning of an oath, and the 31-year-old Rubin, a rabbi himself, knew the words that would follow.

He told the man that he would not repeat them.

That's when the punching began. A relentless onslaught of fists, pummeling his torso and face. Then came the stun gun, jolting Rubin's entire body, over and over. Rubin felt the men pull down his pants, felt the device applied to his genitals. Again and again.

Eventually, the words flowed from him.

". . . willingly consent, being under no duress, to release, discharge, and divorce you to be on your own, you, my wife . . .
". . . so that you are permitted and have authority over yourself to go and marry any man you desire . . .
". . . This shall be for you from me a bill of dismissal, a letter of release, and a document of absolution, in accordance with the law of Moses and Israel."

Three hours after snatching him off the street, at around 10 o'clock on the night of October 23, 1996, his abductors left Rubin, still blindfolded and handcuffed, at the entrance to a cemetery.

Six days a week, 13th Avenue, Borough Park's central commercial thoroughfare, bustles. The sidewalks are crammed, a steady stream of patrons flowing in and out of the many shops. The storefronts, bearing signs written in Hebrew script, are diverse — from shoes to books to fruits and vegetables. Pedestrian attire, on the other hand, is unvarying. The men wear long black coats and wide-brimmed black felt hats. Many carry a book tucked under an arm. The women, who favor long black skirts and running shoes, push strollers.

On Saturdays, 13th Avenue feels like an empty movie set. Even the Duane Reade is closed. Residents of Borough Park honor the Sabbath. According to a 2011 study by the United Jewish Appeal–Federation of Jewish Philanthropies of New York, more than three-fourths of the neighborhood's population of 170,000 is Jewish. The district's city councilman, David Greenfield, has called Borough Park "the Jewish capital of the United States."

The first local synagogue opened its doors in 1904, about the time Jewish immigrants began building a community in the neighborhood. Waves of new families from Europe arrived following each World War. Through the second half of the 20th century, as Americans of all faiths uprooted for the suburbs, Borough Park's population turned increasingly Orthodox, a trend fueled by an influx of immigrants who practiced the ultra-conservative Haredi strain of Judaism. The UJA–Federation study reported that 80 percent of Borough Park Jews classified themselves as Orthodox. Only 2 percent classified themselves as Reform, the religion's most popular liberal denomination in the U.S. Among the respondents, 94 percent answered that their "closest friends are mostly Jewish."

In Borough Park, faith is deeply embedded into day-to-day life. Present in buildings: Affixed to the right side of nearly every doorframe is a mezuzah. Present in travel: Inside the B110 bus, which offers special express service between Borough Park and Williamsburg but doesn't accept MetroCards, a sign reads, "When boarding a crowded bus with standing passengers in the front, women should board the back door after paying the driver in the front." Present in disagreements: Community members rarely take their legal disputes to civil court, choosing instead to settle them through a Jewish rabbinical court, a beth din. An insular legal system governed by Jewish law, the beth din perhaps best embodies the community's self-sufficiency.

For the court's proceedings, litigants typically hire an advocate, known as a to'ein, to argue the case.
In Borough Park, few to'anim were as prominent as Mendel Epstein.

Epstein, now 68, was known to many in the Orthodox Jewish community as a devoted feminist. Stout and bald, with a bushy beard and a steely demeanor, he specialized in divorces. Over three decades he built a reputation for effectively representing women. Says one local rabbi, "He presented himself as a champion for the underdog."

The women who came to Epstein often had a singular problem: Their husbands refused to grant them a get, a document without which an Orthodox Jewish marriage cannot be dissolved. The rule can be traced to the biblical Book of Deuteronomy, and its sway remains stifling: Without a get, a woman who remarries is considered adulterous. Any children fathered by her new husband are illegitimate under Orthodox law and prohibited from marrying within the faith.

You may consider this as my magnum opus indictment on Bais Din! All Batei Din! - (in the plural)

Three is a chazaka, and according to the Talmud, one may make assumptions on a particular mazik or predator based on three separate independent incidents of intentional damage. We know the example the Talmud uses for the "ox that gores." He loses his status as a Tam, or accidental/happenstance predator, and becomes a shor ha'Muad on the third goring.  One must assume that an ox that gores three times is a danger to society, and the owner is put on notice that he is fully responsible for all the damages caused by his ox, not merely chatzi nezek, or partial damages.

So if I were to bring a suit against "Bais Din", on behalf of Klal Yisroel, I have my three undisputed cases of intentional harm inflicted on the Nation of Israel, by three independent incidents of intentional abuse of the bais din system, by three independent batei din - recognized  perhaps by many Jews as reputable batei din, but not by me. Truth be shared, I have scores of cases of bais din abuse in my files, accumulated over the years.

The first one is well known; the case of Rabbi Yisroel Belsky, acting on behalf of the bais din he heads, issuing a subpoena or a hazmana to Eli Greenwald, to appear before him and his tribunal; the charges alleged were "defamation of character" or motzei shem ra for attempting to call a parent meeting at Yeshiva Torah Temima regarding the then allegations leveled against Rabbi Yehuda Kolko for child molestation.

    http://theunorthodoxjew.blogspot.com/2006/08/fraud-that-is-yisroel-belsky.html

One does not have to be a nuclear scientist to come to the conclusion, that Belsky was using bais din, the present day replacement of the Sanhedrin, as a personal tool to scare Greenwald off. Belsky had known for years that Kolko was a danger to children, he was called before the "Scheinberg" bais din decades earlier and heard testimony leveled at Kolko from none other than his good friend Rabbi Shmuel Dishon of Yeshiva Karlin Stolin, who tossed Kolko out of Stolin for these very allegations of child rape.

In addition, the Talmudic adage of "kolo d'lo pasuk", or the stories never cease,...applied to allegations against Kolko for pedophilia since he was a teenager in Camp Agudah, the camping arm of the Agudath Israel of America, that Belsky heads.

To add additional salt to our collective wound, Belsky came to "rescue" Kolko's nephew of Lakewood, who was accused of child rape, claiming loudly that no one could go to the police in Yossi Kolko's case lest they be excommunicated from the Jewish community. The child that was molested and came forward to file a police complaint, was a child of a rabbinic family who would have none of Belsky's supposed halacha, or rulings. The father lost his job at Beth Medrash Govoha, and the innocent victimized child was not permitted to attend any yeshiva in New Jersey. Literally, the rabbinic hangmen posse, rode these innocent souls out of Dodge.

It is clear now to the masses, finally, after pouring my heart out to anyone who would listen, that the plague of child rape, is not only a disease of society at large, but embedded deep into the inner school system of yeshivas and girls'schools, and the clergy leadership of the Jews. Belsky, to me, is the driver of Kolko's getaway car, after Kolko bombed a yeshiva to smithereens and killed hundreds of its innocent kids. What we are dealing here is with dinei n'fashot, one must sacrifice themselves rather than directly be involved, or be an accessory to murder.  Belsky, at the very least, is an accessory to murder of God knows how many innocent children!...And he is the head of Yeshiva Torah Vodaath, with hundreds of vulnerable children under his spell.

The second case is just as glaring in its own right, throwing Yahadus to the dogs, up for bid for either personal sexual pleasure or other reasons that have nothing to do with the meritocracy of becoming a converted Jew; and aiding in the destruction where Leib Tropper left off, converting undeserving gentiles to Judaism for personal benefit. The rabbinic head of Yeshiva University, Rabbi Hershel Schechter,  under the auspices of the RCA, the Rabbinical Council of America, "converted" Ivanka Trump to "Orthodox Judaism", knowing full well that she was living with her boyfriend Jared Kushner during the two year Process, who observes NOTHING! Rabbi Moshe Feinstein's well known psak regarding these conversions, is posted on the UOJ sidebar as well for anyone that cares.

Rabbi Moshe Feinstein states the very marriage of a gentile woman to a non observant Jew, is equivalent to an open declaration that she will not observe the precepts. This is so, because it is highly unlikely that the gentile member of such a union, will be more committed to Judaism than her remiss Jewish husband (certainly when they are living together prior to their marriage). Unlike mental or tacit negations, explains Rav Feinstein, open declarations do invalidate conversions. When such cases appear before a rabbinical court, its members actually become witnesses to an acceptance declaration that is not sincere. Therefore, it is no longer a tacit insincerity, but rather an obvious one. As such, they are forbidden to sanction the conversion. Regardless of what this Jewish court may declare, the conversion is invalid and the person is not deemed a member of the Jewish nation. In Iggros Moshe, Letters of Moshe (Yoreh De’ah, no. 157), he writes that “According to the Law, it is certain that one who converts for the sake of marriage, does not intend to keep the commandments, and is not a proselyte at all.”

    http://theunorthodoxjew.blogspot.com/2011/12/trump-family-christmas-december-25-2011.html

I have written much about Trump post-conversion, celebrating Christmas, posing half nude in a Playboy Bunny outfit on the cover of Harpers Bazaar, publicly desecrating the Shabbos, eating non-kosher food publicly and privately with her now husband Jared Kushner. Not only do we not now know Who is a Jew, we don't know anymore What is a Jew, and equally as important, WHAT IS A RABBI?

What do young, vulnerable kids learn from this episode?

JUDAISM IS FOR SALE! And they're right!

Who is the "Birthright"- type teenager suppose to emulate if not Jared Kushner and Ivanka Trump?

The damage you've done to Yahadus is beyond your grasp.

The third case I bring forward is documented above. I have abbreviated my letter to Rabbi Avraham Union of the RCC for relevance.

Once and for all time, I intended to put Sholom Tendler out of reach of any rabbinic organization, yeshiva, girls school, and his ability to be in daily intimate contact with women, under the guise of being a posek of hilchat nidah. To the folks that do not know what that means, is that Tendler gets the right to talk sex with women, probing their sex lives in all its detail; the origin of their menstrual bleeding, whether it was "dam makeh" or rough sex (loosely translated), or was the spotting on her underwear that he examines,  the continued flow of blood from her period. He gets to do this at his leisure, when he closets himself with vulnerable women at his home or at his office making certain that his wife and nobody is around. For the sake of modesty, more details will not be forthcoming in this forum, at least for the present time.

After some probing by Avraham Union the managing head of the RCC, I disclosed a bit of the evidence I intended to produce at bais din. Not only did Union not get back to me once revealed, he did indeed unashamedly cash the checks issued to him.  No hazmana was ever sent to Tendler, and of course no siruv. Avraham Union has been desperately seeking a job out of Los Angeles, thanks to me, no one yet is willing to hire this thieving con-man. Flipping the bird back at ya Union - you little kike!

Sholom Tendler sits today on the RCC board. One wonders about the ability of this group to understand simple right and wrong.

I am now convinced that any criminal can sit on any bais din, and will be protected by their comrades.

The question you need to ask yourselves is --- can bais din ever be trusted in any matter?
